Abstract

This research examines the intersection of climate justice and constitutional rights in India. It analyzes how climate change disproportionately affects vulnerable communities and how judicial interpretations of Article 21 have expanded the scope of environmental protection. By reviewing Supreme Court precedents and India’s international commitments, the paper advocates for codifying climate justice as a constitutional right to ensure equitable and sustainable development. Comparative insights from global cases reinforce the need for systemic legal reforms in India’s environmental governance framework.

Conclusion

India’s climate justice trajectory reflects both progress and limitations. With strategic reforms and participatory governance, India can redefine its climate policy landscape and emerge as a global leader in environmental constitutionalism.
